About these terms 1.1 These terms are the agreement between you and Litty Gaming Pty Ltd (ABN 12 677 142 853, ACN 677 142 853) of Level 29, 66 Goulburn Street, Sydney NSW 2000 ("Litty", "we" or "us") for using the Litty apps, website and everything in them. By creating an account or using Litty, you agree to them. If you don't agree, please don't use Litty. 1.2 Other terms also apply: - (a) Our Privacy Policy, which explains how we handle your information. - (b) Each draw's own terms, which take priority over these terms for that draw. - (c) Any offer or promotion's own terms, shown where you enter it. - (d) Apple's or Google's terms, if you downloaded Litty from their store. Apple and Google aren't responsible for Litty. ## 2. Who can use Litty 2.1 You must be 18 or over and live in Australia. 2.2 You can have one account. Accounts are personal: don't share, sell or transfer yours. 2.3 You can't use Litty if we have closed an account of yours before, or if you are an employee of Litty or a partner running a draw you want to enter, where that draw's terms say so. ## 3. Your account 3.1 Keep your details accurate and your sign-in private. You're responsible for what happens on your account, so tell us straight away if you think someone else has used it. You can close your account at any time in Settings. ## 4. Coins and items 4.1 Litty is free to play. You earn coins and items by playing, and nothing in Litty requires you to pay. 4.2 Coins and other in-app currencies have no cash value. You can't buy them, cash them out, or exchange them for money. 4.3 Items (such as rings, charms, stickers, boosts and draw entries) are licensed to you for use in Litty. You don't own them, and they have no value outside the app. 4.4 Don't sell or trade them outside Litty. Buying, selling or swapping coins, items or accounts for money or anything else outside the app isn't allowed. 4.5 We can change them. We may change what coins and items do, what things cost, or how they are earned, and items or currencies may expire where the app says so. 4.6 They end with your account. If your account is closed, any coins, items and entries on it are lost. 4.7 If we make a mistake, such as giving coins or an item by error, we can correct it. ## 5. Contests and predictions 5.1 Contests ask you to predict what happens on a show. They are entertainment, not betting: you never stake money, and coins are not money. 5.2 Picks lock at the time the contest shows. A pick can't be changed after it locks. 5.3 We settle results from what airs, using our judgement where a question is unclear. Our result is final. 5.4 We can void a question or a whole contest if it was wrong, unclear, broadcast early or affected by a fault. When we void, we return what you spent to enter. 5.5 Shows change. We don't control broadcasters, and a contest may move or close if a show does. ## 6. Draws, prizes and rewards 6.1 Draws are free to enter: entries come from playing, never from paying. Each draw has its own terms, which say who can enter, the prizes, how winners are picked and when. Those terms win over these if they differ. 6.2 Winners are picked at random, under any permit the draw needs. 6.3 To claim a prize you may need to show ID, prove you are 18 or over, and give a postal address. If you can't be contacted or don't claim it in time, we may redraw it. 6.4 Prizes can't be swapped for cash unless the draw's terms say so. If a prize becomes unavailable, we may give one of equal or greater value. 6.5 Tax and costs. Any tax on a prize, and costs the draw's terms don't cover (such as travel), are yours. 6.6 Rewards from partners are subject to the partner's terms too. ## 7. The store, trades, auctions and wagers 7.1 The store sells items for coins, while stock lasts. Limits per person may apply. Delivery times for anything we send are estimates. 7.2 Trades between players swap items only. Once both sides accept, a trade is final. 7.3 Auctions take coins when you bid and return them if you're outbid. A winning bid is final. 7.4 Room wagers (such as who buys dinner) are just for fun between friends. Litty doesn't enforce them and no money changes hands through Litty. ## 8. Fair play 8.1 Litty only works if everyone plays fair. You must not: - (a) run more than one account, or enter a draw more than once through other accounts; - (b) use bots, scripts, or anything that automates play or reads the app in ways it isn't built for; - (c) exploit a bug, glitch or error to gain coins, items or entries; - (d) share answers from early broadcasts, or use insider knowledge of a show's outcome; - (e) interfere with Litty's systems or other players' accounts. 8.2 If we reasonably believe you have, we may remove coins, items, entries or prizes gained that way, disqualify you from draws, and suspend or close your account. Our systems may flag accounts automatically; a person reviews it if you dispute it. ## 9. Community rules and your content 9.1 Comments, chat, rooms, profile pictures and nicknames are public to other players. Be decent. Don't post anything that is: - (a) abusive, threatening, hateful, sexual or harassing, including about people on the shows; - (b) someone else's private information, or a spoiler from an early broadcast; - (c) spam, advertising, scams or links to them; - (d) illegal, or someone else's work you don't have the right to share. 9.2 You keep ownership of what you post. You give us a free, worldwide licence to show, store and share it in Litty and in our promotion of Litty, for as long as it's on Litty. We may hide or remove anything that breaks these rules, and we check some posts automatically. Report anything that worries you from the post itself. ## 10. Partners, ads and other services 10.1 We run some contests, draws, rewards and offers with partners, and Litty shows ads from advertisers and sponsors. A partner's offer or prize may come with the partner's own terms. Links and connected apps that take you outside Litty are run by others, and we aren't responsible for them. 10.2 Shows, networks and people on the shows aren't connected with Litty unless we say so. ## 11. Our content and the app 11.1 Litty, its name, design, art, characters and content belong to us or the people we license them from. You may use the app for your own personal, non-commercial use. Don't copy, resell or reverse-engineer it. 11.2 We keep improving Litty, so features, shows, contests and rewards change, and some end. We aim to keep it running but can't promise it will always be available or free of errors, and we may pause it for maintenance. ## 12. Liability and your consumer rights 12.1 Nothing in these terms takes away rights you have under the Australian Consumer Law that can't be excluded. Where those guarantees apply and we fail one, we will fix it, replace it or refund it as the law requires. 12.2 Otherwise, as far as the law allows, Litty is provided as it is. We aren't responsible for losses that come from things outside our reasonable control, such as a broadcast change or a provider outage, or for loss of coins or items, which have no cash value. Our total liability to you is limited to the amount you have paid us in the 12 months before the claim, or A$100 if that is more. ## 13. Closing accounts, changes and contact 13.1 Closing accounts. You can close yours at any time. We may suspend or close an account that breaks these terms, puts others at risk or is used to cheat, and we'll tell you why unless the law or safety stops us. If you think we got it wrong, contact us and a person will review it. 13.2 Changes. We may update these terms as Litty changes. We'll show the new date here and tell you in the app before a change that affects you takes effect. If you keep using Litty after that, the new terms apply. 13.3 Law.
